General Terms and Conditions

1. Introduction
These General Terms and Conditions (Terms) govern your use of the spiritual phone‑psychic services (Services) provided by Branwell Pty Ltd t/a Soul 2 Path (ABN 38 642 130 676) (we, our, us). By accessing or using the Services you agree to be bound by these Terms, our Privacy Policy, any Service‑specific disclosures and all applicable laws and regulations of the Commonwealth of Australia and the State of Queensland.
2. Definitions
Client (you, your) means any natural person aged 18 years or older who accesses or receives our Services.
Reading means any psychic consultation, mediumship, tarot, oracle or related intuitive guidance provided by our readers via telephone or other remote communication.
Prepaid Minutes means any quantum of time, charged in whole minutes, purchased in advance by you to fund Readings, also referred to as psychic minutes or session credits on our website and invoices.
3. Guidance‑Only Disclaimer
All Readings are offered for guidance, insight and entertainment purposes only. Information imparted during a Reading does not constitute legal, financial, medical, psychological or other professional advice and must not be relied upon as a substitute for consultation with qualified professionals. We do not guarantee that any prediction, advice or statement made during a Reading will be accurate, realised or beneficial. You acknowledge that any decisions or actions you take based on a Reading are your sole responsibility.
4. Eligibility and Capacity
You must be at least 18 years of age and have the legal capacity to enter into a binding contract under Australian law to use our Services. By proceeding with a Reading you warrant that you meet these requirements.
5. Payments, Pricing and GST
Service fees are charged in Australian dollars (AUD) and include goods and services tax (GST) where applicable. Current rates are displayed on our website or advised verbally prior to connection with a reader. Charges begin once the Reading commences. You are responsible for any carrier, telephone or data costs associated with your call. Payments may be processed via pre‑authorised credit/debit card, direct debit or other methods offered from time to time.
6. Prepaid Minutes – Purchase, Use and Inactivity Expiry
6.1 Purchase and Redemption
Prepaid Minutes are purchased in advance and applied to your account. They may be redeemed solely for Readings provided by Soul 2 Path and have no cash value. Prepaid Minutes are non‑transferable and may not be exchanged for money.
6.2 Inactivity Expiry Policy
IMPORTANT NOTICE – PLEASE READ CAREFULLY. Any Prepaid Minutes remaining in your account will be permanently forfeited and set to zero if your account has been inactive for a continuous period of 90 calendar days or more.
For the purposes of this clause:
• inactive your account is considered;
• if no Reading has been commenced or Prepaid Minutes redeemed during the 90‑day period; and
• the 90‑day period is measured from the date of your last account activity (including the last date on which any Prepaid Minutes were used).
6.3 Advance Notice and Reminders
We will endeavour to send reminder communications to the mobile number registered on your account weekly. Failure to receive a reminder (for example, due to an outdated mobile numbering or blacklist filtering) does not prevent expiry from occurring. It is your responsibility to keep your contact details current.
6.4 Expiry Process
Expiry is applied automatically by our system each evening. Once Prepaid Minutes are forfeited under this clause they cannot be reinstated. If you believe an expiry has been applied in error, you must contact Customer Care within 14 days of the expiry date. We will review the matter and, at our sole discretion, may offer a goodwill credit.
6.5 Disclosure at Point of Sale
This inactivity expiry policy is disclosed at the point of purchase on our website and in your purchase confirmation email. By completing a purchase of Prepaid Minutes you acknowledge that you have read and understood this policy.
6.6 Australian Consumer Law
Nothing in this clause excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law (ACL) or any other applicable legislation that cannot be excluded by agreement. If you consider that the inactivity expiry policy is inconsistent with your statutory rights, please contact Customer Care or seek independent legal advice
7. Cancellation and Refund Policy
You may end a Reading at any time by hanging up. We do not provide refunds for Services already rendered unless required under the Australian Consumer Law (ACL). If you believe you have been incorrectly charged, please contact our Customer Care team within 48 hours of the Reading.
8. Australian Consumer Law Guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL or any other applicable legislation that cannot be excluded, restricted or modified by agreement. Where we are permitted to limit liability for breach of a consumer guarantee, our liability is limited (at our option) to supplying the Services again or paying the cost of having the Services supplied again.
9. Limitation of Liability
Subject to Clause 7, we are not liable for any loss, damage, cost or expense (including indirect, special or consequential loss) arising out of or in connection with your use of the Services, including reliance on any Reading, except to the extent such liability is caused by our negligence, wilful misconduct or fraud.
10. Health and Emergency Disclaimer
We are not a crisis or emergency service. If you are experiencing thoughts of self‑harm, domestic violence, addiction or any health emergency, immediately contact 000 or a qualified professional such as Lifeline (13 11 14) or Beyond Blue (1300 22 4636).
11. Privacy and Data Protection
We collect, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Telephone calls may be recorded for quality assurance, training and compliance. By using the Services you consent to such recordings.
12. Intellectual Property
All content, trademarks and materials presented during a Reading or on our website are protected by intellectual property laws and remain our exclusive property or that of our licensors. You must not reproduce, distribute or exploit any such content without prior written consent.
13. Suspension and Termination
We reserve the right to refuse service, suspend or terminate your access to the Services at our sole discretion, including for non‑payment, abusive behaviour, or breach of these Terms.
14. Complaints and Dispute Resolution
If you have any concern or dispute regarding the Services, please notify us in writing at [email protected]. We will endeavour to resolve the matter promptly and in good faith. If a dispute remains unresolved, either party may refer the matter to the Queensland Civil and Administrative Tribunal (QCAT) or another competent authority.
15. Amendments
We may update these Terms from time to time to reflect changes in law, practice or our Services. Revised Terms will be posted on our website with the effective date. Continued use of the Services after the effective date constitutes acceptance of the amended Terms.
16. Governing Law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Federal Courts of Australia.
